PREAMBLE

These General Terms and Conditions of Sale and Use (hereinafter "T&Cs") govern
access to and use of the website www.kesso.com as well as all services and products
offered by KESSØ Femmes (hereinafter "Seller", "we", "KESSØ").

By accessing the site and purchasing products, you fully accept these T&Cs.
If you do not agree, please do not use our site.

Consumer = natural person (non-professional) purchasing products for personal use.
Professionals: Different conditions available upon request.

2. SITE ACCESS

2.1 ACCESS CONDITIONS

You agree to:

— Be of legal age (18+)
— Not use the site for illegal purposes
— Not bypass security (hacking, code injection, etc.)
— Not spam/abuse other users
— Not copy/reproduce content without permission

2.2 MODIFICATION/SERVICE INTERRUPTION

KESSØ may:
— Modify the site without notice (maintenance, improvement)
— Temporarily interrupt service (maintenance)
— Remove sections/features
— Modify product prices/availability

**Warning:** We will notify you by email if an interruption lasts > 4h.

2.3 LIMITATION OF LIABILITY

— Site provided "AS IS" without warranties
— KESSØ not responsible for temporary unavailability
— KESSØ not responsible for viruses/malware (antivirus recommended)
— KESSØ not responsible for loss of customer data (backup is your responsibility)

2.4 EXTERNAL LINKS

The site may contain links to third-party sites (suppliers, social networks, etc.).

3. PRODUCTS AND CATALOGUE

3.1 PRODUCT DESCRIPTION

**Accuracy:**
— Photos: Representative of actual color (screen variations possible)
— Descriptions: Detailed, based on supplier data
— Sizes: Size guide provided (customer's responsibility to measure)
— Materials: Specified (linen, rayon, organic cotton, etc.)
— Price: Including VAT at 20% French rate

**Limitations:**
— Spocket stock photos may vary slightly from product received
— Minor imperfections (stitching, label) normal for craftsmanship
— Color variations possible from batch to batch (natural linen)

3.2 PRODUCT AVAILABILITY

— Stock displayed is informative (real-time via Spocket)
— No guarantee of availability: Supplier may run out of stock
— In case of out-of-stock: Full refund or substitution with similar product

3.3 PRICE

— All prices displayed include VAT (20% VAT included)
— Prices subject to change without notice
— Temporary special offers mentioned with time limit
— Price applied = price at the time of order validation

**Pricing errors:**
— If a manifest error (obvious input mistake):
  * KESSØ has the right to refuse the order
  * Full refund if order already paid
  * Email notification within 24h

3.4 SALES LIMITATION

— KESSØ has the right to limit quantity per product/customer (max 3 items of same size/color)
— Protection against scalping/resale

3.5 INTELLECTUAL PROPERTY

**KESSØ content (texts, photos, designs, logos):**

**Customer content (reviews, photos, comments):**
— You grant KESSØ a license to use your content
— KESSØ may share customer reviews/photos (with requested consent)
— You retain copyright to your content

**Trademarks:**
— "KESSØ" is a registered trademark of KESSØ Femmes
— Unauthorized use prohibited
— Counterfeiting will be legally prosecuted

4. ORDER AND PURCHASE

4.1 ORDER PROCESS

**Steps:**
1. Product selection + sizes/colors
2. Cart validation
3. Address entry (shipping + billing)
4. Shipping method selection
5. Payment via Stripe
6. Email confirmation with details

**Validity:** Order valid after payment accepted.

4.2 MODIFICATION/CANCELLATION BEFORE SHIPMENT

— Free cancellation if requested < 24h after order
— Modification possible (address, size) if requested < 12h
— After: Request refund then reorder (new fees)

**Procedure:**
— Email hello@kesso.com urgently
— Subject: "Order cancellation [number]"
— Response time: 2h on working days

4.3 REFUSED ORDERS

KESSØ may refuse an order if:
— Payment refused/fraudulent
— Address not found/dubious
— Security doubt (aberrant patterns)
— T&Cs violations detected

**Notification:** Email with reason, refund within 7 days.

4.4 GROUP/BUSINESS ORDERS

— Discounts possible for quantity >= 10 items
— Business contact: hello@kesso.com with details

4.5 RIGHT OF WITHDRAWAL (14 DAYS)

**Legal basis:** Directive 2011/83/EU (EU consumer rights)

**Period:** 14 calendar days from package receipt.

**Withdrawal conditions:**
— Unworn items
— Tags attached
— Original packaging intact
— Receipt acknowledged or proof of purchase

**Exceptions (NON-returnable):**
— Worn swimwear/intimates
— Personalized/engraved items
— Sale products if marked "non-returnable"
— Opened/used utensils/accessories

**Procedure:**
1. Email hello@kesso.com: "Withdrawal request [order number]"
2. Receive return label (free)
3. Repackage package to the provided return address
4. Send package (insurance recommended)
5. Upon receipt inspection: Refund 7-14 days after

**Refund includes:**
— Product amount
— Initial shipping costs
— VAT

**Refund does NOT include:**
— Return shipping costs (at your expense unless KESSØ error)
— Customization fees (engraving, embroidery)
— Products damaged by you

**Bank account:** Refund to the same payment method (credit card = credited)

5. DELIVERY AND SHIPPING

5.1 DELIVERY ZONES

**Metropolitan France:**
— Lead time: 3-7 business days
— Cost: €4.90 (free for orders over €60)
— Provider: Spocket (logistics partner)

**Europe (EU):**
— Lead time: 7-14 business days
— Cost: €9.90
— Customs: Customer's responsibility (VAT + duties)

**International (outside EU):**
— Lead time: 14-30 business days
— Cost: On quote (contact hello@kesso.com)
— Customs: Customer's responsibility
— Responsibility: Customer after departure from France

**Non-delivered zones:**
— French Overseas Departments and Territories: Special quote
— Certain countries: Legal/customs restrictions
— Contact: hello@kesso.com to check feasibility

5.2 DELIVERY TIMES ARE INDICATIVE

— Displayed times are "estimated" not guaranteed
— Possible delays: Supplier, carrier, customs
— KESSØ not responsible for carrier delays
— Insurance: To be taken out by the customer if high value

5.3 PACKAGING

— Eco-friendly packaging (recycled cardboard, paper)
— Standard product protection (not indestructible)
— Fragile items: Request reinforced packaging (possible fees)

5.4 PACKAGE TRACKING

— Tracking number sent by email
— Tracking available 24-48h after shipment
— Tracking via Spocket/carrier website
— Carrier responsibility once package picked up from KESSØ

5.5 DELIVERY TO ADDRESS

— KESSØ responsibility until handover to carrier
— Carrier responsibility for delivery to indicated address
— Once delivered = customer responsibility

**Problems:**
— Damaged package: Refuse or document with photo, contact hello@kesso.com
— Lost package: Carrier responsible (KESSØ assists with process)
— Wrong address: Customer responsible (cannot correct once handed to carrier)

5.6 SIGNATURE DELIVERY

— Not required by default (at carrier's discretion)
— Possible to request (potential additional fees)
— Contact: hello@kesso.com before ordering

5.7 PICK-UP DELIVERY

— Not currently available
— To be considered in the future: Contact for request

6. PAYMENT

6.1 ACCEPTED PAYMENT METHODS

— Credit/debit cards (Visa, Mastercard, American Express)
— Apple Pay
— Google Pay
— Other methods depending on Stripe availability

6.2 PAYMENT SECURITY

— Payments processed by Stripe (PCI-DSS Level 1)
— Card data never stored by KESSØ
— SSL/TLS encryption (HTTPS protocol)
— Optional 3D Secure (strong authentication)

6.3 PAYMENT CONFIRMATION

— Payment confirmed by email immediately
— If payment refused: Reason explained, possible to retry
— Failed attempts: Contact bank or hello@kesso.com

6.4 PAYMENT FRAUD

— Automatic fraud detection by Stripe
— May block suspicious payments (protects customer + KESSØ)
— Unblocking possible with identity justification
— Contact: Stripe support or hello@kesso.com

6.5 CURRENCY

— Displayed currency: EUR (€)
— Automatic conversion for payment in another currency: Bank fees are your responsibility
— KESSØ not responsible for exchange fees

6.6 RECEIPT AND INVOICE

— Receipt sent by email after payment
— Invoice available in customer account
— Download/print possible
— Legal invoice for returns/refunds

7. REFUNDS AND RETURNS

7.1 REFUND REASONS

**Full refund possible if:**
— Defective product (broken stitching, hole, factory stain)
— Product not compliant with description (very different color, different material)
— KESSØ error (wrong product sent, incorrect size label)
— Customer withdrawal (14-day legal right)
— Order not received (after delay + localization attempt)

**Partial refund possible if:**
— Product damaged by customer (worn, dirty, damaged)
— Late return (> 14 days) but good condition
— Customer return fees deducted (if customer responsible)

**No refund if:**
— Customer changes mind (satisfied but prefers another color)
— Worn swimwear/used intimates (hygiene)
— Sale product "non-returnable" (clarified before purchase)
— Opened/used accessories
— Customer responsible for product damage

7.2 RETURN PROCESS

**Request:**
1. Email hello@kesso.com within 14 days of receipt
2. Subject: "Return/refund [order number]"
3. Detailed reason + photos if defect
4. Response time: 48h

**Approval:**
— KESSØ verifies request
— Return label provided (free if KESSØ error)
— Return shipping costs at your expense unless KESSØ error

**Physical return:**
1. Package repacked complete and in good condition
2. Use provided return label
3. Send registered mail (insurance advised)
4. Keep proof of shipment/tracking

**Inspection and refund:**
— Upon receipt, KESSØ inspects product (7 days)
— If compliant: Refund authorized
— Refund processed 7-14 days after approval
— Bank account credited (same payment source)

7.3 RETURN PERIODS BY REASON

7.4 IMPOSSIBLE RETURN

— Products too old/damaged = return refused
— KESSØ may refuse product not in compliant condition
— Customer may claim partial refund (depending on condition)

7.5 PRODUCT NOT RECEIVED

— France lead time: 7 days before search
— EU lead time: 14 days before search
— KESSØ investigates with supplier + carrier
— If confirmed lost: Full refund

8. CUSTOMER ACCOUNT

8.1 ACCOUNT CREATION

**Required data:**
— Email (unique)
— Password (secure recommended: >8 characters, mixed case)
— First name and last name
— Standard size (optional, for recommendations)
— Color preferences (optional)

**Responsibilities:**
— You are responsible for password confidentiality
— KESSØ is responsible for theft/hacking beyond your control
— Account sharing prohibited
— Illegal use → account suspension/deletion
